USCIS Statistics on EB-1A, EB-2 NIW, and O-1: Where Is the Approval Rate Higher?

We analyzed official USCIS data for the past three fiscal years (FY2023–FY2025) across three widely used categories: EB-1A, EB-2 NIW, and O-1.


The purpose of this analysis is to highlight overall approval trends and observe how adjudication patterns have evolved.


EB-1A


EB-1A remains a stable category.The approval rate has consistently held at 71–72% for three consecutive years.

At the same time, approximately one out of every three applicants receives a denial.

This underscores the importance of building a truly strong evidentiary record, particularly given the increase in filings.


EB-2 NIW


In the EB-2 NIW category, we see a clear downward trend in approval rates.

The category has become more competitive, and the risk of denial has increased significantly compared to 2023.


Today, NIW petitions require far more structured and strategically developed argumentation than they did two or three years ago.


O-1


O-1 remains the most statistically predictable category in terms of approval rates.

Even when factoring in RFEs, the final approval rate exceeds 90%.

However, a high approval rate does not mean the category is “easy.”It indicates that when a case is properly prepared, the likelihood of success is strong.
