USCIS is updating Forms I-539 and I-765: an important change effective September 15, 2026

Starting September 15, 2026, USCIS updating Forms I-539 and I-765:

Form I-539 — Application to Extend/Change Nonimmigrant Status

Form I-765 — Application for Employment Authorization


The edition date for both new forms will be September 15, 2026.

⚠️ There will be no grace period.


Until September 15, USCIS will continue to accept:


— Form I-539 edition dated August 28, 2024

— Form I-765 edition dated August 21, 2025


However, if an older edition is postmarked or electronically submitted on or after September 15, 2026, USCIS will reject it.


USCIS will accept the new editions dated September 15, 2026 only if they are filed on or after September 15, 2026. They should not be filed before that date.


The changes are related to a new rule concerning periods of stay and extensions of status for international students, exchange visitors, and representatives of foreign information media.


If you are planning to file Form I-539 or Form I-765 in September, make sure to check the form edition date immediately before filing.
