USCIS Begins Accepting Online I-140 Filings for EB-1A and EB-2 NIW

USCIS has introduced the option to file Form I-140 online for the EB-1A (Extraordinary Ability) and EB-2 NIW (National Interest Waiver) categories. Although the agency has not yet issued an official public announcement, the new feature has already appeared inside MyUSCIS accounts — marking the initial rollout of the electronic filing system.

What We Know So Far
Applicants can now see both EB-1A and EB-2 NIW as available categories for online filing within their MyUSCIS profile. This means the I-140 petition process can now be started completely online.
How the New Online Filing Works: 4 Key Steps
Based on current functionality, the online filing process includes:
1. Selecting the Category
Choose EB-1A or EB-2 NIW directly in the MyUSCIS interface.

2. Uploading the Completed I-140 PDF
You must upload a filled-out PDF version of Form I-140.
Maximum file size: 12 MB.

3. Uploading Supporting Evidence
All evidence that would normally be mailed as part of a paper submission must be uploaded electronically.

4. Review, E-Signature, and Submission
After reviewing your filing, the system will ask for an electronic signature and allow you to submit the petition.

Important Notes
USCIS has not yet published:
official instructions,
updates to the I-140 webpage,
or a public press release.
The feature appears to be in the early stages of implementation.
We expect official guidance from USCIS soon.
Why This Matters: Potential Benefits
Once fully launched, the online filing system could significantly improve the process:
no more printing hundreds of pages,
no need to mail large packages,
faster receipt notices,
fewer delivery delays or lost packages,
potential for fully electronic RFEs (both issuance and responses).
If implemented as expected, this could become one of the most impactful improvements USCIS has made for EB-category applicants.
