Our Client’s EB-1C Green Card Has Been Approved

We are pleased to share another successful case: our client has received approval of a green card under the EB-1C immigrant category — one of the most underestimated yet powerful options available for business owners and top executives of international companies.

The EB-1C category is not widely known because it is not designed for a broad range of applicants. This green card is intended for business owners, senior executives, and managers who make strategic decisions and oversee companies at an international level.

A key requirement is prior managerial or executive experience outside the United States: the applicant must have worked in such a role for at least one year within the past three years for a foreign company.

EB-1C is also suitable for companies with an international structure where there is a clear corporate relationship between the business abroad and the U.S. company. This relationship may take the form of a parent company and subsidiary, a branch office, or an affiliated entity. Importantly, both the foreign company and the U.S. company must be engaged in real, active commercial operations and not exist solely on paper.

From an immigration perspective, EB-1C stands out for its significant advantages. It is a permanent immigrant category that leads directly to a green card, rather than a temporary visa status. The PERM labor certification process is not required, and there is no fixed minimum investment threshold. The U.S. company serves as the sponsor and must offer the applicant a managerial or executive position that aligns with their professional background and level of responsibility.

Another notable benefit of EB-1C is that it allows the entire family to obtain permanent residence. The applicant’s spouse and unmarried children under the age of 21 receive green card status at the same time as the principal applicant, without the need for separate immigration filings.

EB-1C is a strategic immigration solution for business, not a one-size-fits-all pathway. For this reason, each case requires a careful analysis of the company’s structure, the applicant’s actual job duties, and full compliance with U.S. immigration requirements.

If you would like to determine whether your business qualifies for EB-1C, we are ready to conduct an initial assessment and review your situation during an individual strategic consultation.
